Does L-1A create different dependent work rights from L-1B?

THE DIRECT ANSWER

Qualifying L spouses may be employment-authorized incident to status with appropriate documentation; the principal’s A or B label does not replace the spouse’s individual status review.

Check the actual family records

An employment authorization document is not universally required for a qualifying L spouse. Children do not receive work permission solely from L dependent status. Hypothetical example: an aquarium-exhibit design manager whose partner plans a career change after relocation.

At a first review, the first review should separate the transferee’s L eligibility from the partner’s own authorization, school, and timing questions. The records most likely to settle that point are civil-status records, passports, each person’s proposed activity, I-94 information after admission, and children’s age records. Sequence the work deliberately: choose travel and employment commitments only after the family’s individual status steps are clear.

A common error is assuming the principal’s senior role transfers an identical work right to every accompanying family member; that error matters because a conclusion based on incomplete or mismatched facts may not carry to the final arrangement. Write down the decision that remains after the review, the fact that could change it, and the record needed to resolve that fact. This creates a usable file rather than a collection of documents that cannot be connected to the actual plan.
