Can the spouse work because the household owns part of the business?

THE DIRECT ANSWER

Ownership alone does not establish the spouse’s immigration permission. Qualifying E spouses may be employment-authorized incident to status with appropriate documentation.

Review the spouse’s actual status

Identify intended duties and individual evidence. Dependent children do not receive work permission solely through E status. Hypothetical example: a bicycle-repair franchise investor whose spouse plans to manage a separate online retail business.

At a first review, the first review should identify the spouse’s exact proposed activities rather than assuming ownership by the household answers them. The records most likely to settle that point are marriage record, passports, proposed duties, entity documents, admission records, and children’s school plans. Sequence the work deliberately: choose the business and family structure together, then confirm status evidence before paid work begins.

A common error is letting the spouse start a different business because the principal invested in the first enterprise; that error matters because a conclusion based on incomplete or mismatched facts may not carry to the final arrangement. Write down the decision that remains after the review, the fact that could change it, and the record needed to resolve that fact. This creates a usable file rather than a collection of documents that cannot be connected to the actual plan.
