Peterborough guide: compare U.S. options using actual citizenship

USAvisa field guide · 2 minute readReviewed 7 September 2026
THE SHORT ANSWER

Canadian permanent residence and U.S. route eligibility answer different questions. When comparing offers or business opportunities, start with the applicant’s actual citizenship and intended activity rather than assuming residence in Canada makes all options available. Hypothetical example: a marine-sediment analyst with Canadian permanent residence and French citizenship is offered a listed professional role. The threshold decision is whether any claimed route matches nationality as well as the activity. Residence evidence belongs in the personal file, but it cannot supply citizenship where the route requires it.

01

Correct assumptions in each proposal

Hypothetical example: one employer assumes a Canadian resident can use TN while another suggests an internal transfer. TN requires eligible Canadian or Mexican citizenship and the relevant professional criteria. Record the actual citizenship and qualifications before treating the first proposal as workable; an employer’s process suggestion does not establish eligibility. Ask the employer to state its proposed category and why it believes the applicant qualifies. The concrete choice is whether to correct that premise or examine a different lawful option before planning work.

02

Assess the different route on its own requirements

A genuine L proposal needs the qualifying entity relationship, relevant foreign employment and qualifying U.S. role. An E-2 proposal needs qualifying treaty nationality, investment and enterprise facts. Do not describe either as an automatic replacement for TN or combine evidence from unrelated opportunities into one apparent case. Build a separate evidence folder for every possible route. The decision-maker should be able to see which facts belong to a qualifying organization, which belong to an investment, and which belong to the person.

03

Include individual family and process questions

Record the citizenship, relationship and intended activities of each accompanying person. Confirm the actual application steps appropriate to the chosen facts before arranging travel. The final choice should reflect the substantive requirements and household needs, while present U.S. activity remains governed by actual current permission. Set family travel, remote-work and school plans against the selected route’s actual dependent rules. A household cannot solve a citizenship mismatch by calling everyone a Canadian applicant.
