Hypothetical example: a Selwyn instrumentation firm builds control systems for small municipal water plants and wants a controls specialist to spend a period at a U.S. utility commissioning its proprietary platform. L-1B requires one continuous year of qualifying employment abroad within the three years before the petition and a parent, branch, subsidiary or affiliate relationship between foreign and U.S. entities that are both actively doing business, but the beneficiary's distinguishing feature is specialized knowledge of the company's own product, process or procedures rather than general professional skill. Where the work happens at a client site, a second condition applies: the placement must not amount to labour for hire, and the petitioner must continue to control the work.

Start with the L-1B eligibility and application overview

01

Separate proprietary knowledge from a marketable skill set

Specialized knowledge may consist of special knowledge of the petitioning organisation's products, services, research, equipment, techniques, management or other interests and their application in international markets, or advanced knowledge of its processes and procedures. It need not be proprietary or unique, and L-1B does not impose a U.S. labour-market test. General expertise alone is insufficient, so the evidence should identify the qualifying organisation-specific knowledge, explain how the beneficiary acquired it and connect it to the proposed duties.

02

Document how the knowledge was acquired inside the group

The origin and use of the claimed organisation-specific knowledge are relevant evidence, not a requirement that the knowledge be proprietary. Training records, internal documentation the beneficiary wrote or maintains, and project histories showing how the knowledge was acquired and applied can help. Evidence that few people hold the same capability may support the claim, but scarcity is not a separate mandatory threshold. Dates and named systems make the explanation checkable without turning uniqueness into the legal test.

03

Keep control of the work when it happens at a client site

Offsite placement is permitted but conditioned. The arrangement must not be essentially the provision of labour for hire, and the petitioner must retain control over the beneficiary's work — supervision, direction, and responsibility for the deliverable. The controlling documents are the service contract and the reporting structure, not a description written afterwards. A Selwyn-based firm should be able to point to the clause that makes the client the recipient of a service rather than the employer of a person, and to a supervisor within the petitioner who directs the work day to day.

04

Plan the placement inside a five-year ceiling

L-1B status is limited to five years in total, shorter than the L-1A ceiling, and time already spent in L status counts. A commissioning programme expected to run in phases over several years should be planned against that limit from the outset rather than discovered against it later. Where the role would genuinely evolve into directing a function and supervising staff, that is a different classification with different evidence, and the change should be assessed on its own facts rather than treated as a continuation.

05

Describe the actual specialized knowledge

If the principal worksite belongs to an unaffiliated employer, L-1B is barred when that employer principally controls and supervises the worker. Avoid claiming the knowledge is unique if a dozen colleagues have it; describe the actual distribution honestly. A statement that an employee is highly skilled and hard to replace describes a valued worker rather than a specialized-knowledge position, and officers read the difference quickly. The record should distinguish ordinary familiarity with a product from the employee's documented application of the company's particular methods.
