An L-1 transfer and an E-2 investment can be considered in the same consultation, but each needs its own coherent facts. Compare the actual choices instead of constructing a hybrid arrangement from unrelated evidence. Hypothetical example: a clean-room validation engineer may transfer to a related U.S. affiliate or purchase a separate calibration laboratory. The decision is whether to preserve a related-company transfer with a qualifying foreign year or make an at-risk treaty investment in a nonmarginal enterprise. Neither path borrows the other’s evidence, and L-1A and L-1B have seven- and five-year caps.
Name the concrete decision
Hypothetical example: an employee can pursue a related-company role or buy into a separate enterprise. Record the employer, duties, ownership and funding for each. State which terms are negotiable. Do not assume the transfer’s corporate relationship also supports a different acquisition. List the non-negotiable facts on each side: related entities and qualifying employment for L-1; nationality, control and committed capital for E-2. Choose which arrangement the evidence can prove today.
Identify the requirements that separate the choices
L-1 needs the qualifying organizations, foreign employment and managerial, executive or specialized-knowledge role. E-2 needs qualifying treaty nationality, committed substantial capital at risk and the real nonmarginal enterprise the applicant will develop and direct. Available funds do not establish qualifying L employment, and seniority does not establish E-2 control. Ask whether the employee’s actual duties are managerial, executive or knowledge-based, then separately ask whether the investor can develop and direct the purchased business. The answers may point to different people.
Compare the next commitments and family implications
Identify which evidence could change the choice, such as actual management support or voting rights. Include spouse work and children’s study plans. Qualifying E and L spouses may be employment-authorized incident to status with appropriate documentation; children do not gain work permission solely through dependent status. Review the chosen facts before relying on contracts or travel dates. Make a household decision only after checking spouse work, children’s plans and the duration of the selected classification. A desirable business opportunity does not expand status permission by itself.
