Peterborough L-1 guide: choose a launch role that matches the actual work

USAvisa field guide · 2 minute readReviewed 7 September 2026
THE SHORT ANSWER

A business deciding between a management launch role and a specialist assignment should use the actual responsibilities and applicable new-office requirements. The strongest wording from two different roles should not be combined into a job the company does not intend to create. Hypothetical example: an independent wheelchair-design manufacturer can send either its operations lead or its materials-testing specialist to form a U.S. office. The decision is which person will perform the actual first-year role and whether that role has the right L-1 foundation. Each candidate must have the qualifying year abroad; L-1A and L-1B also have different seven- and five-year total-stay limits.

01

Describe the proposed launch alternatives

Hypothetical example: one role would direct a function supported by operational staff, while another would train employees in an internal procedure. Record who performs day-to-day work, what authority exists and what knowledge is used. Establish the qualifying company relationship and foreign employment without assuming the role title answers those questions. Record who will make decisions, who will perform routine work and who knows the company-specific system. Choose a candidate whose daily job matches the evidence instead of combining the candidates’ strengths.

02

Use the appropriate A or B requirements

L-1A new-office review includes sufficient premises, required foreign managerial or executive employment and ability to support the intended managerial or executive role within one year of approval. L-1B requires assessment of specialized knowledge, premises and financial ability to pay the employee and begin doing business. Do not impose the managerial role test on the specialist alternative. Secure records for premises, financing and the related entities before presenting the plan. The decision is whether the launch can support the proposed role by the extension review, not merely open a legal entity.

03

Base later steps on actual operations

The new-office framework concerns a U.S. organization doing business for less than one year, with initial approval limited to at most one year. Keep actual operating and role records as the business develops. A forecast is not proof that operations occurred, and an initial approval does not guarantee an extension or permission for a materially different assignment. Maintain payroll, contracts, organization charts and work records during the first year. When operations differ from the forecast, decide whether a change needs review before relying on the original description.
