Hypothetical example: the retiring Otonabee-South Monaghan dairy couple hold part of their farm's price under a vendor take-back mortgage payable over seven years. Comparing EB-5 with the Gold Card on price alone misses the point for this household. The deciding differences are when each route requires the money to actually exist in an account, how long it must stay committed afterwards, and whether any of it can ever come back. Read both against the payment schedule.
EB-5 asks for capital now and keeps it invested for years
The qualifying capital, currently $1,050,000 or $800,000 for a targeted employment area or infrastructure project under the 2022 Reform and Integrity Act, must be invested or actively in the process of being invested and placed at risk. It then has to be sustained through conditional residence until Form I-829 is filed with evidence that at least ten full-time jobs for qualifying United States workers were created or will be. For a couple whose money arrives in instalments, the earliest realistic filing date is the month received funds reach the threshold with a margin, and the money remains committed long after that. Re-verify the current amounts, which have changed.
The Gold Card is a gift, and a gift is gone
The official framework involves a gift to the U.S. government plus a processing fee. No asset is acquired, no return is expected and the money should be treated as unrecoverable. That is the reverse of EB-5's proposition, where the capital is at risk of loss but remains the investor's and may be returned if the project performs. There is also no job-creation obligation and no two-year conditional period to manage under the gift framework as published, which some households read as simplicity and others as receiving less for more. Read the current official page directly and note the date you read it.
Test each against the payment schedule and the downside
Lay the take-back schedule beside both routes. For EB-5, mark the month the threshold is reached, add the petition and visa stages, and add two years of conditional residence before the condition-removal filing; then ask what happens if the project underperforms or a job-creation shortfall appears. For the Gold Card, mark the point at which the published amounts would have to be paid, and ask what remains if plans change afterwards. A household that needs access to its capital within five years should see that clearly on the page before choosing. Neither route should be decided from a headline figure.
