THE SHORT ANSWER

Hypothetical example: an Otonabee-South Monaghan dairy farm's herd manager is a Brazilian citizen and a Canadian permanent resident; his wife, a Canadian citizen, keeps the books for two local businesses. The United States offer is his. Because permanent residence does not create TN eligibility and Brazil is not an E-2 treaty country, the household's realistic options run through her, not him. That reverses who is planning what, and it changes the honest answer the family should hear first: the person with the offer may not be able to accept it.

01

Sort the routes by each person's nationality first

TN is available to citizens of Canada and Mexico only; a permanent resident card, however long held, does not qualify anyone. E-2 requires the nationality of a treaty country, both for the investor and for the ownership of the enterprise, and Brazil does not have a qualifying treaty for this purpose. L-1 does not depend on nationality at all, but it requires a qualifying employer with related entities on both sides of the border and one continuous year of employment with that organisation, which a single family farm with no American company cannot supply. Running this sort takes ten minutes and it eliminates most of the confusion in one pass.

02

Identify who can actually be the principal

If the herd manager cannot be the principal applicant, the question becomes whether his wife can. Her Canadian citizenship opens TN if she has prearranged professional employment in a listed profession and holds the credential that entry requires; bookkeeping and accounting are not the same thing, and the Accountant entry requires a baccalaureate degree or a recognised professional designation. If she qualifies and takes a position, he would be admissible as a TD dependant. That is a genuine option with a hard limit attached, and the limit is the next paragraph.

03

Be honest about the outcome nobody wants to say

A TD dependant may live in the United States and may study, but may not work. In this household that means the herd manager, whose career is the reason the family is considering the move, would have no employment authorisation. Some families accept that for a defined period; many do not, and the honest advice is that no wording of an application changes it. Note too that permanent residents have a residency obligation in Canada, so extended absence has consequences on the Canadian side as well. Both facts belong in the conversation before anyone gives notice.

A CONVERSATION IS A GOOD PLACE TO START.
