IN THIS GUIDE · Show knowledge that belongs to the company, not to the trade
Start with the L-1B eligibility and application overview
Identify the knowledge as a thing, then attach the person to it
Hypothetical example: a seed-treatment company operating from Otonabee-South Monaghan developed a proprietary polymer coating and application sequence for treating cereal and soybean seed, and wants to send the chemist who wrote the process to commission the same line at its United States affiliate. Name the process. Then show the chemist's authorship through dated development records, the internal specification, revision history and validation reports. Knowledge described only as fifteen years of experience is a career, not a specialisation.
Distinguish it from what any competent chemist would know
The most useful test is what a replacement would have to be taught. If a well-qualified seed-treatment chemist hired from outside could do the job after ordinary onboarding, the knowledge is general. If the replacement would need months inside the company to learn coating formulations, calibration tolerances and the failure modes discovered during four seasons of trials, that is knowledge special to the organisation. Write that comparison down honestly, with an estimated training period and what it would cover.
Offsite work at a customer site has its own conditions
If the chemist would spend part of the assignment inside a customer's treatment facility, the petition must show that the placement is not essentially labour for hire. The transferee must remain controlled and supervised by the petitioning employer, performing duties that involve the company's specialised knowledge, not filling a staffing need for the customer. Set out who directs the work, who pays, how the assignment is scoped and when it ends.
The clocks are shorter than for L-1A
L-1B status is limited to five years, against seven for L-1A. Time already spent in the United States in L or H status counts toward the maximum. If the plan is a long American career rather than a defined transfer, that ceiling should be discussed at the outset, together with whether an immigrant route would need to start years before the limit arrives. Deciding this late converts a planning question into a departure date.
