IN THIS GUIDE · Compare internal training work with a general technical assignment
Explain what would actually be taught
Hypothetical example: one role involves teaching the employer’s advanced internal procedure, while another uses broadly available tools for routine delivery. Describe the specific knowledge, the employee’s acquisition and its use in each role. Do not assume every trainer has specialized knowledge merely because the employer calls the material internal. Describe the procedure, product or internal system with enough specificity that a reviewer can see why this employee’s knowledge is advanced or special to the organization.
Use the actual knowledge standard
Review special knowledge of the organization’s products, services or related interests and international application, or advanced knowledge of its processes and procedures. There is no universal requirement that the knowledge be unique or secret. Provide a substantive explanation instead of a claim that no other worker could ever learn it. Compare internal manuals, controlled training records and project evidence with the proposed duties. A résumé of broadly transferable skills will not do the same work.
Connect evidence to personal experience
Use genuine records of training, development, projects and prior responsibilities. Distinguish the applicant’s own contribution from general company expertise. Establish the qualifying corporate relationship and required foreign employment as well as the knowledge itself. Match each asserted contribution to a dated record and a knowledgeable witness. General company success is not proof of the individual’s qualifying knowledge.
Check the actual U.S. working arrangement
Identify duties, supervision and any customer placement. Principal placement at an unaffiliated employer’s worksite requires assessment of control and supervision and whether it is labour for hire rather than a qualifying placement tied to the petitioning employer’s product or service requiring specialized knowledge. Compare the real alternatives before selecting a proposal. Where a customer site is involved, record who directs assignments, evaluates performance and controls the deliverable. The commercial contract alone may leave those facts unclear.
Complete the foreign-employment and new-office assessment
L-1B generally requires one continuous qualifying year of foreign employment within the relevant preceding three-year period, along with qualifying organizations that meet the doing-business requirements. Assess actual dates and locations; U.S. days do not count toward the foreign year. For a U.S. organization doing business for less than one year, the L-1B new-office evidence includes sufficient premises and financial ability to pay the employee and begin doing business. Initial new-office approval is limited to at most one year. Decide whether the real assignment needs this knowledge now. A later specialist project cannot make an unrelated initial role fit the L-1B standard.
