THE SHORT ANSWER

Hypothetical example: an Asphodel-Norwood tool-and-die owner intends to build an American operation and stay with it for a decade. Both L-1 and E-2 could start that plan, but they end differently: L-1A is capped at seven years and L-1B at five, while E-2 can be renewed indefinitely so long as the enterprise qualifies and offers no direct route to permanent residence.

01

The L classifications have hard ceilings

L-1A status is limited to a maximum of seven years and L-1B to five, and time previously spent in the United States in L or H status counts toward those totals. The ceilings are not extended because the business is going well or because the transferee has become indispensable. For a ten-year plan this means an L route must be treated as the opening phase, with a decision point built in years before the limit arrives. Many companies pair an L-1A transfer with an employment-based immigrant petition begun early, since the managerial and executive category has a natural relationship to that classification, but that requires deliberate planning rather than discovery in year six.

02

E-2 renews indefinitely but leads nowhere by itself

A treaty investor may be granted status and renew it repeatedly for as long as the enterprise remains real, operating, non-marginal and owned at least fifty percent by treaty nationals, and for as long as the investor continues to develop and direct it. There is no cumulative maximum. The trade is that E-2 confers no direct path to permanent residence: an investor who wants that must qualify under an immigrant category on its own terms. Each renewal also re-examines the business, so a period of poor performance is an immigration issue as well as a commercial one.

03

Decide what the tenth year is supposed to look like

Write down the intended end state. If it is permanent residence, the route chosen at the start should be compatible with a plan to get there, and the immigrant filing should begin far earlier than feels necessary. If it is a long operating period after which the family returns to Canada, an indefinitely renewable classification tied to a business the family controls may suit better than a status that expires. If the answer is genuinely unknown, say so and choose the option that preserves the most future choices, then revisit it annually rather than at the point where one door has already closed.
