Your expertise.Across borders.

L-1B asks whether an employee holds special knowledge of the petitioning organisation's product, service, equipment, techniques or procedures, or advanced knowledge of its processes, and whether that employee has one continuous year of qualifying employment abroad within the preceding three years. Both questions become more complicated when the employer grew by acquisition. An Asphodel-Norwood water-treatment systems company that bought a smaller competitor now employs specialists whose expertise was developed somewhere else, and the file has to connect the knowledge and the employment history across that transaction. A first review should produce three separate answers: the corporate relationship, the continuous qualifying employment, and the knowledge the American role actually needs. Corporate records, dated payroll and job history, and internal product or training material settle those points; a résumé alone usually settles none. Hypothetical example: an Asphodel-Norwood workshop that makes robotic bookbinding machines plans to send its firmware diagnostician to an American affiliate after a software release. The decision is whether the person's knowledge concerns the organisation's release controls and fault library, or skills a competent automation technician can acquire quickly.

Start with the L-1B eligibility and application overview

01

Trace the knowledge to the organisation as it now exists

Hypothetical example: an Asphodel-Norwood company that designs and services rural and municipal water treatment systems acquired a smaller firm whose membrane cleaning protocol it now sells under its own name. The applications specialist who developed that protocol is the natural transferee. The petition must show that the protocol is now the petitioner's own procedure, through the asset or share purchase agreement and the internal documentation issued after integration, and not merely something the specialist once did elsewhere. Before drafting, decide whether the explanation relies on a purchased asset, an entity succession or a transferred workforce. Each calls for a different documentary chain. A product label adopted after closing does not itself establish the petitioner's rights in the underlying procedure.

02

The qualifying year can span an acquisition, but it must be shown

Where a business is acquired, employment with the acquired entity may count toward the one continuous qualifying year if the successor relationship is properly established, and the payroll record will usually change employer name partway through. Provide the purchase agreement, the employee's continuity of service documentation, and payroll from both periods. Do not leave a reviewer to infer that two employers are the same organisation; state it and prove it with the transaction documents. Build a dated timeline before preparing support letters. Pay records, tax records, job descriptions and any leave records show the actual sequence, while a later job title does not repair an unexplained gap.

03

Distinguish the protocol from the discipline

Membrane cleaning is a field with published chemistry and industry practice. What makes the knowledge special is the company's own protocol: the sequence, the concentrations, the tolerances and the diagnostic decision tree developed from its own installed base and failure history. Say what a competent externally hired process engineer would still need to be taught, name the specific procedures, and estimate the training period. A claim that the specialist is simply very experienced does not meet the standard. The useful comparison is between the proposed employee and a capable new hire, not between the employee and a novice. Training materials, controlled-access records and examples of troubleshooting decisions can show what cannot be learned from ordinary industry material.

04

Watch the five-year ceiling and any offsite placement

L-1B status is limited to five years and previous time in L or H status counts against it. If part of the assignment will occur at a municipal client's plant, the petition must show the transferee remains directed and controlled by the petitioner, performing work involving its specialised knowledge, rather than being supplied as labour to the client. Set out the contract, the supervision arrangements and the defined end point of the placement. Name the petitioner's manager, the person who evaluates the employee, and the work product the client receives. If the contract instead describes open-ended staff augmentation, the company should resolve that mismatch before it relies on the assignment.
