IN THIS GUIDE · Take the terms from the official page and record what you read
Start with the GOLD CARD eligibility and application overview
The official page is the record that governs
Where a framework is defined by the government's own description rather than by a long-settled statutory scheme, the published text is the primary evidence of what it requires. Secondary accounts drift, and even careful summaries age. A household should read the current official program page and FAQ directly, save a copy, and note the date of reading. If a plan depends on a particular provision — who may participate, what is paid, what happens if vetting is unsuccessful — that provision should be quoted into the household's own file so that any later change is visible rather than invisible.
A gift is not investment capital, in any record
The distinction should be maintained in the household's documents as strictly as in its thinking. EB-5 capital is invested in a commercial enterprise, remains at risk, belongs to the investor, and is tied to job creation and a later removal of conditions. A gift to the U.S. government is not recoverable, creates no enterprise, and carries no jobs obligation. Keeping the two in separate files prevents an accountant, an adviser or a family member from later describing one in the language of the other, which is the most common way the comparison becomes confused.
Corporate arrangements raise their own questions
Where the published material describes a corporate route alongside an individual one, the household needs to know from the official source how a corporate arrangement works, what maintenance or transfer conditions attach, and what happens to the position if the corporate relationship changes. Those are not questions to be answered by analogy with employment-based categories. A Cavan Monaghan household whose assets sit inside a holding corporation should also take separate tax and corporate advice, since the structure that suits the framework may have consequences under Canadian law.
Money does not answer eligibility or admissibility
Capacity to pay does not displace the official personal conditions. Each applicant must be eligible for lawful permanent resident status, admissible and covered by an available visa, and Executive Order 14351 directs the gift to be treated as evidence under specified EB-1 and EB-2 grounds. The processing fee is paid before I-140G review and DHS vetting and is nonrefundable; the gift is requested only after successful vetting. A Cavan Monaghan household should confirm each participant's current instructions and re-verify the program before submitting either amount.
Follow official payment and family terms
The official FAQ identifies an eligible spouse and unmarried children under 21 and recommends initial inclusion of intended joining relatives. The gift does not waive inadmissibility grounds, does not create a visa number where the category is backlogged, and does not exempt the family from medical and security screening. Official State Department visa and medical costs may also arise; neither a private all-inclusive quote nor payment itself guarantees residence, work permission, approval or a completion date. Gold Card is therefore a programme framework using existing immigrant classifications, not a standalone conventional visa classification or an EB-5 investment.
