IN THIS GUIDE · Evidence the source of funds and the jobs, from the first day
Start with the EB-5 eligibility and application overview
A land sale produces a specific documentary set
Proceeds from real property require their own chain: title records, the agreement of purchase and sale, the statement of adjustments, the lawyer's trust ledger, the deposit into the vendor's account and the tax treatment of the gain. Where the property was held jointly, through a partnership or in an estate, each holder's entitlement has to be shown and the distribution to the investor traced. Farmland held for decades often carries an incomplete acquisition history, so the original purchase and any intervening transfers may need to be evidenced as well.
Job creation is proved twice, in different ways
The initial petition uses a credible plan, projections and the applicable methodology. At Form I-829, operating records must show that at least ten full-time jobs for qualifying U.S. workers were created or can be expected to be created within a reasonable time. Payroll, tax and employment records support that showing, and regional-centre cases use the approved indirect-job methodology where applicable. The two stages therefore use different evidence, but the later test is not limited to jobs already in existence on the filing date.
Engagement in the enterprise has to be recorded
The investor must be engaged in the management of the new commercial enterprise, through day-to-day managerial control or policy formulation. In a limited-partnership structure the partnership agreement's rights may satisfy this; in a direct investment the evidence is the investor's actual role. Either way the position should be documented rather than assumed: the agreement, the roles conferred, and any record of participation. A file that describes an active investor without any document conferring a role invites the question of what the investor actually does.
The conditional period generates its own file
Approval leads to two years of conditional permanent residence for the investor and qualifying family members. Form I-829 is ordinarily filed in the ninety days before the second anniversary of conditional admission, with evidence that the investment was sustained and that ten qualifying full-time jobs were created or can be expected within a reasonable time. The file is assembled from records generated during the conditional period, so the enterprise's bookkeeping forms part of the immigration evidence. Derivatives are the spouse and unmarried children under twenty-one.
Understand engagement and job creation in a regional-center project
Reserved allocations exist for rural areas, high-unemployment targeted employment areas and infrastructure projects alongside the unreserved category, and visa availability can differ among them. A purchase option exercisable solely at the enterprise’s discretion has a narrow statutory exception, subject to the required sustainment and other conditions; it is not an investor’s repayment guarantee. Read the offering documents, escrow provisions, repayment priorities, fees, borrower security and job-creation methodology with qualified financial advisers. A regional-center filing should identify the relevant offering documents, economic report and how the project allocates jobs. A promoter's assertion that a site is rural or high-unemployment is a claim to be verified against the current designation, not a fact established by the marketing deck.
