THE SHORT ANSWER

Hypothetical example: a Douro-Dummer welding supervisor who has held Canadian permanent residence for eight years is told by a U.S. fabricator that Canadians simply present at the border. The statement is true of Canadian citizens and untrue of this applicant, and correcting it early prevents a start date being promised on a route that was never available.

01

Where the misunderstanding comes from

Employers who have hired Canadian citizens build expectations around that experience: no petition, no consular appointment, a decision at the border. Those expectations are then applied to anyone living in Canada. Permanent residence establishes lawful status in Canada; it is not nationality, and TN is available to citizens of Canada and Mexico. The correction should be made in the first conversation rather than after a start date has been circulated internally, because the alternative routes carry different lead times and costs, and the employer may need to take a decision it did not expect to face.

02

What remains available, and on what facts

The L classification does not depend on nationality at all. It turns on a continuous qualifying year of employment abroad with the organisation within the preceding three years, a qualifying parent, branch, subsidiary or affiliate relationship between entities that are both doing business, and duties that are managerial, executive or specialized-knowledge in character. A permanent resident employed by a Canadian company with a related U.S. entity may fit well. The treaty investor route does turn on nationality, but on treaty-country nationality generally, so the applicant's actual citizenship and whether that country holds a qualifying treaty is the question to answer.

03

Two immigration systems running at once

A household in this position has obligations on both sides of the border. Canadian permanent residence carries a residency obligation that extended absence can affect, which is a question for Canadian advice but belongs on the same plan because the two interact directly. Where naturalisation is available and wanted, its timeline would change which U.S. routes open, so the household should establish where it stands before assuming any date. Deciding both questions together avoids the pattern where a U.S. plan is built and then found to conflict with maintaining the status the household intends to keep.

A CONVERSATION IS A GOOD PLACE TO START.
