Read the general immigrant investor briefing overview
Hypothetical example: a Douro-Dummer household is presented with EB-5 and the official Gold Card framework side by side as the two money options, distinguished mainly by amount. That framing is the error. The two create different obligations, different risks and different ongoing requirements, and comparing them by price alone conceals everything that matters.
What EB-5 actually commits the household to
EB-5 capital is invested in a new commercial enterprise, remains the investor's capital, must be genuinely at risk, and is tied to the creation of at least ten full-time positions for qualifying U.S. workers. The source and path of every dollar must be documented. It leads to two years of conditional permanent residence, followed by a petition on Form I-829 ordinarily filed in the ninety days before the second anniversary of conditional admission, proving that the capital stayed invested and the jobs were created. That is a multi-year obligation with ongoing record-keeping, not a single transaction.
What the Gold Card framework is described as
The government describes a framework involving a gift to the U.S. government together with a processing fee. It is not a conventional visa category of the kind TN, L-1 or E-2 belong to. A gift is not recoverable, creates no enterprise, carries no jobs requirement and generates no removal-of-conditions filing. Published terms have referred to per-person amounts including for a qualifying spouse and eligible unmarried children under twenty-one, and to different levels for individual and corporate arrangements. Because those terms have been revised, they should be read from the current official page and dated.
What neither of them buys
Eligibility and admissibility are assessed individually under both, and payment does not displace them. Neither guarantees a timeline. The useful comparison is therefore between obligations rather than amounts: capital at risk with a jobs requirement and years of compliance on one side, a non-recoverable payment with its own assessment process on the other. A Douro-Dummer household should ask which obligation it can actually carry, keep the two files strictly separate, verify the framework's current terms immediately before any commitment, and be willing to re-decide if they have changed. Recording what the official source said, and on what date, is what makes that re-decision possible rather than theoretical.
