IN THIS GUIDE · Ask whether the knowledge came from the company or from the vendor
Start with the L-1B eligibility and application overview
Trace the knowledge back to its origin
Ask where each element of the specialist's expertise came from. Manufacturer training on a purchased controller, certification on a third-party platform, and industry qualifications are all valuable and none of them is the company's own knowledge. What counts is what the petitioner developed: its own product design, its own integration method, its own service procedures, its own diagnostic approach. Where the role genuinely combines both, the file should separate the layers and build the case on the proprietary one rather than presenting a blended description that reads as general technical competence.
Ask how many people could do this
Scarcity is not a formal requirement in itself, but it is the question that tests the claim. Hypothetical example: if a dozen employees hold the same capability and it takes a competent technician three weeks to learn, the knowledge is probably not distinguishing. If three people hold it and each took two years of internal project work to develop it, that is a different picture and one the company can evidence. Ask the question honestly inside the business before asserting an answer externally, because the internal answer is what the records will show.
Ask who will direct the work at the client site
Placement at a dealer or customer site is permitted, but the arrangement must not amount to labour for hire and the petitioner must retain control of the beneficiary's work. The questions to put during contract negotiation are who sets the specialist's tasks, who supervises day to day, who carries responsibility for the deliverable, and what the client is actually buying. If the honest answers put the client in charge, the arrangement will be characterised accordingly however the invoice is worded, and the time to fix that is while the scope of work is being drafted.
Ask what happens at year five
L-1B status is limited to five years, and prior time in L status counts towards it. Businesses commonly plan the first placement carefully and give no thought to the ceiling, then face it with a customer relationship that still depends on one individual. The question to ask at the outset is what the plan is for years six and beyond: local staff trained to the same standard, a second employee developed through the qualifying year and the internal knowledge, or a role that will genuinely have changed character and would be assessed on its own facts as something else.
