IN THIS GUIDE · Compare two offers using separate profession analyses
Describe both jobs without merging their duties
Hypothetical example: one offer emphasizes professional analysis while another includes substantial sales and operational coordination. Ask each employer for the real duties. Do not use the first employer’s professional description to support the second employer’s materially different job. Preserve a separate duty matrix, supervisor name and worksite statement for each offer so a comparison can be revisited when either employer changes scope.
Test the precise profession for each option
Identify the proposed listed profession and applicable credential requirements, including permitted alternatives where relevant. The same applicant may have suitable credentials while one role still does not fit. Canadian permanent residence alone does not satisfy TN citizenship eligibility. Put the governing profession entry beside the transcript, credential evaluation where needed and any practice-authority record; that reveals a missing element early.
Compare the employment arrangements
Identify the actual employer, any intermediary or customer relationship, duration and applicant ownership interests. TN does not provide a general U.S. self-employment authorization. Review each arrangement on its facts rather than assuming a job title or corporate label resolves the issue. Review corporate ownership and control before signing. A proposed arrangement can fail because the applicant is effectively providing services through an enterprise they control.
Use the selected proposal’s current documents
Once a choice is made, ensure the evidence describes that actual offer. If terms change, reassess material differences. A choice between employers is a commercial decision; the appropriate immigration permission and its conditions govern whether and when the work can begin. Choose one proposal before preparing travel or filing steps. A changed client, duty mix or employer can require a fresh TN analysis rather than a cosmetic update.
Apply the temporary-work and credential boundaries
TN concerns qualifying temporary professional activity for Canadian or Mexican citizens. Providing services to a U.S. entity solely owned or controlled by the applicant falls outside the permitted arrangement; a foreign business interest alone is not a blanket disqualification. Degrees from institutions outside Canada, Mexico and the United States require a reliable foreign-credential evaluation. Any licence needed to practise the profession in the United States is a separate question from the listed TN qualification. The practical decision is whether the selected job can be documented as temporary professional employment now, not whether either offer sounds attractive in conversation.
