DOURO-DUMMER · E-2 FIELD GUIDE

What should a Douro-Dummer household ask about a spouse's position in an E-2 move?

THE DIRECT ANSWER

Whether the spouse intends to work, and where. A qualifying E spouse is employment-authorized incident to status and may work outside the enterprise; children may study but may not work.

Ask what the spouse actually wants to do

Households frequently assume the spouse will work in the business because that is the plan under discussion, and only later discover that the spouse would rather continue their own occupation. The rule accommodates either: authorization arises from status rather than from any role in the enterprise, so employment elsewhere is possible. Two follow-up questions matter.

What documentation will a U.S. employer expect, and how is it obtained in this case. And if the spouse's occupation is licensed, what does the destination state require, since that process is separate, slower and outside the immigration system entirely.

Children in dependent status may attend school but do not obtain work permission through a parent, and a child approaching adulthood should be planned for individually rather than assumed to continue.
